Right of withdrawal

Cancellation policy and cancellation form
Consumers have the right to withdraw from a contract in accordance with the following provisions, a consumer being any natural person who enters into a legal transaction for a purpose that, for the most part, cannot be attributed to either his commercial activity or his independent professional activity:

The user has the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which the Contractor or a third party designated by the Contractor, who is not a carrier, entered or took possession of the last goods.

To exercise your right of withdrawal, you must inform us (Grosik Supermarkt HOD GmbH, Prager Str. 69, 1210 Vienna) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by mail or e-mail). For this purpose, you can use the attached model withdrawal form, which, however, is not mandatory.

In order to meet the withdrawal deadline, it is sufficient for you to send a notice of exercise of your right of withdrawal before the withdrawal period expires.

Consequences of repeal
If you withdraw from this contract, we must return all payments received from you, including the costs of delivery (except for additional costs resulting from the fact that you have chosen a type of delivery other than the cheapest standard delivery offered by us), immediately, and at the latest within fourteen days from the day on which we have received information about your withdrawal from this contract. We will use the same payment method used for the original transaction for the refund, unless otherwise expressly agreed with you; in no case will you be charged for this refund. We may refuse to refund your money until you receive the goods back or until you provide proof that you have returned the goods, whichever comes first.

The goods must be returned or handed over to us immediately, and in any case no later than fourteen days from the day you informed us of your withdrawal from this contract. The deadline is met if you send the goods before fourteen days.

We bear the cost of returning such goods, which by their nature can normally be returned to us by mail. The customer shall bear the direct costs of returning goods that, due to their nature, cannot be returned to us in the usual way by mail (forwarding goods), estimated at a maximum of about EUR 400 for each such good. The passenger must pay for the loss of value of the goods only if the loss of value is due to handling of the goods that is not necessary to check the condition, properties and functioning of the goods.

Exclusion or premature expiration of the right to withdraw from the contract
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and in the production of which the consumer’s individual choice or decision is decisive, or which are clearly tailored to the consumer’s personal needs.

The right of withdrawal does not apply to contracts for the supply of goods that may spoil quickly or whose expiration date would be quickly exceeded.

The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for health or hygiene reasons, if the seal has been removed after delivery.

The right to withdraw from the contract does not apply in the case of:
– Goods that can spoil quickly or whose expiration date has passed quickly;
– Goods made to the customer’s specifications or clearly customized;
– Goods that are delivered as sealed and are not returnable for health or hygiene reasons, provided that their seal was removed after delivery;
– Newspapers, dailies or periodicals, except for subscription contracts for such publications.

General Instructions
1) Avoid damaging or contaminating the goods. Please return the goods in the original packaging with all accessories and packaging items. Use the outer protective packaging if necessary. If you no longer have the original packaging, use appropriate packaging to provide adequate protection from damage in transit.
2) Please do not send the goods back to us under the freight collect service.
3) Please note that the above-mentioned points 1-2 are not a condition for the effective exercise of the right of withdrawal.
